General Terms and Conditions (GTC)

for ticket purchases, events and table reservations

As of December 2025

§ 1 Scope and Provider

  1. These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded between Engler's Restaurant GmbH, Binger Straße 16, 55218 Ingelheim (hereinafter referred to as "Organizer" or "Restaurant") and the customer (hereinafter referred to as "Customer" or "Guest") via the website, by e-mail or telephone.

  2. The terms and conditions apply both to the purchase of tickets for events and to the reservation of tables.

  3. Any differing terms and conditions of the customer will not be recognized unless the organizer expressly agrees to their validity in writing.

§ 2 Conclusion of contract when purchasing tickets (events)

  1. The presentation of events and tickets on the website does not constitute a legally binding offer, but rather an invitation to place an order.

  2. By clicking the "Buy" / "Order with obligation to pay" button, the customer submits a binding offer to purchase the tickets in the shopping cart.

  3. The contract only comes into effect when the organizer accepts the order by sending an order confirmation via email or makes the tickets available for download.

  4. The organizer is entitled to refuse orders (e.g., if the quota is sold out).

§ 3 Prices and Payment Terms (Tickets)

  1. The ticket prices shown are final prices and include VAT.

  2. The total price is due for payment immediately upon conclusion of the contract.

  3. The payment methods offered during the ordering process on the website are accepted (e.g. PayPal, credit card, instant bank transfer).

  4. The tickets remain the property of the organizer until full payment is received.

§ 4 No right of withdrawal when purchasing tickets

Important note: According to § 312g para. 2 no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract specifies a particular date or period for performance. This means that ticket purchases for events are binding and cannot be cancelled. Every order for tickets is therefore binding and obligates the customer to accept and pay for them.

§ 5 Return and Refund of Tickets / Cancellation

  1. There is generally no right to a return of tickets or a refund of the purchase price, unless the event is cancelled by the organizer.

  2. Event cancellation: If the event is cancelled (e.g., due to artist illness, technical problems, or force majeure), the ticket price will be refunded. Further claims for damages (e.g., for travel or hotel expenses) are excluded, unless the organizer is at fault.

  3. Postponement: If the event is postponed to a different date, the tickets remain valid. However, the customer has the right to return the tickets if the new date is unacceptable.

§ 6 Table reservations (without ticket purchase)

  1. Binding nature: Reservations made via the online system, email, or telephone are binding for both parties. The restaurant will hold the tables for the guest and refuse service to other guests.

  2. Cancellation: Table reservations can be cancelled free of charge up to 24 hours before the reserved date.

  3. No-show: If the guest does not appear at the reserved time and the reservation has not been cancelled in due time, the restaurant reserves the right to claim a flat-rate compensation fee for the resulting loss, provided the table could not be allocated to someone else.

  4. Expiry of the reservation: The right to the reserved table expires if the guest does not arrive no later than 20 minutes after the reserved time.

§ 7 Transferability of Tickets

  1. The tickets are generally not tied to a specific person and are therefore transferable to third parties.

  2. The commercial resale of tickets at a price higher than the original price is prohibited. In case of violation, the organizer is entitled to block the ticket and refuse entry.

§ 8 Admission and conduct of events

  1. Entry to the event is only possible with a valid ticket (printed or digital ticket on a smartphone).

  2. There is no guarantee of seat selection unless this was explicitly agreed upon at the time of purchase (e.g., assigned seat numbers). Otherwise, seating is on a first-come, first-served basis or assigned by staff.

  3. Late arrival: For events with a stage program, latecomers may only be admitted during suitable breaks. There is no entitlement to immediate admission in case of lateness.

§ 9 House rules and rules of conduct

  1. The organizer exercises the right of domicile on the premises. Instructions from staff must be followed.

  2. The organizer reserves the right to refuse entry to guests or to remove them from the event if:

  3. they disrupt the process

  4. harassing other guests or staff,

  5. are heavily intoxicated or

  6. violated the Youth Protection Act.

  7. In such a case, there is no entitlement to a refund of the ticket price or compensation.

  8. Bringing your own food and drinks is prohibited.

§ 10 Image and sound recordings (rights)

  1. Photography by guests: Photography for private purposes is generally permitted, provided that flash photography and tripods do not cause disturbance. Professional audio or video recordings, as well as photography of stage performances, are prohibited without prior written permission.

  2. Recordings by the organizer: The customer acknowledges that photographs and videos may be taken at events by the organizer or commissioned third parties to document the event and use them for promotional purposes (website, social media). By purchasing a ticket or attending the event, the guest consents (in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR) to being depicted as part of the audience, unless the guest's personal interests override this.

§ 11 Liability

  1. The organizer is liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty.

  2. The organizer is liable for other damages only if they result from an intentional or grossly negligent breach of duty. For slight negligence, the organizer is liable only for breaches of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable damages typical for this type of contract.

  3. No liability is accepted for personal belongings, clothing or valuables brought along.

§ 13 Final Provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

  2. The place of performance and exclusive jurisdiction for all disputes arising from this contract is, to the extent legally permissible, the place of business of the organizer (Ingelheim am Rhein / District Court of Bingen or Regional Court of Mainz).

  3. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected.
